EU New Machinery Directive

Directive 2006/42/EC, also known as the new Machinery Directive, is a European Union legislation that aims to ensure the safety of machinery and protect workers and consumers who use them.

The Directive defines essential health and safety requirements for the design and construction of machinery, as well as specific requirements for certain categories of machinery.

The Directive applies to machinery, interchangeable equipment, safety components, lifting accessories, chains, ropes and webbing, removable mechanical transmission devices and partly completed machinery. Member States are required to ensure that partly completed machinery can only be placed on the market if it meets the relevant provisions of the Directive.

Manufacturers are responsible for certifying that their machinery conforms to the essential health and safety requirements of the Directive, and the CE marking is the only marking recognized as indicating conformity with the Directive. The manufacturer must also conduct a risk assessment of the machinery to identify essential health and safety requirements and take measures to ensure that the machinery can be operated, adjusted, and maintained without putting persons at risk.

The Directive provides for penalties for non-compliance, and Member States are required to ensure effective market surveillance to achieve the proper and uniform application of the Directive.

Annexes to the Directive provide additional information and guidance, including essential health and safety requirements, declarations, CE marking, categories of machinery, safety components, assembly instructions for partly completed machinery, technical files and documentation, and criteria for the notification of bodies. The Directive repeals Directive 98/37/EC on the approximation of the laws of the Member States relating to machinery.
